只放不管必有后患--質檢總局出臺意見加強產品全面質量監管

日前,質(zhi)檢總(zong)局(ju)官(guan)網發布(bu)了《質(zhi)檢總(zong)局(ju)關于加強產品全(quan)面(mian)質(zhi)量監(jian)管的意見(jian)》(以下(xia)簡(jian)稱(cheng)《意見(jian)》),要求一(yi)手(shou)抓全(quan)面(mian)提高質(zhi)量,一(yi)手(shou)抓加強全(quan)面(mian)質(zhi)量監(jian)管,堅(jian)持(chi)"兩(liang)手(shou)"都要抓、"兩(liang)手(shou)"都要硬。

當(dang)前,隨著(zhu)我國經濟發展進入新(xin)常態,產(chan)品(pin)質量安全(quan)(quan)出(chu)現了一些新(xin)問題(ti)和新(xin)挑戰,在供需錯配、產(chan)能過剩、成本上升、市(shi)場競爭(zheng)日趨激(ji)烈的形(xing)勢(shi)下(xia),少數(shu)企業鋌而(er)走險(xian),出(chu)現低(di)價低(di)質競爭(zheng)、摻雜使(shi)假(jia)、以(yi)假(jia)充(chong)真(zhen)、以(yi)次充(chong)好、以(yi)不合(he)(he)格產(chan)品(pin)冒充(chong)合(he)(he)格產(chan)品(pin)等(deng)質量違法行為(wei)。《意見》從(cong)5個(ge)方面就加強產(chan)品(pin)全(quan)(quan)面質量監(jian)管提出(chu)要求:一是(shi)(shi)堅持(chi)放管結合(he)(he),實現監(jian)管對象全(quan)(quan)覆蓋;二是(shi)(shi)堅持(chi)嚴字當(dang)頭,形(xing)成全(quan)(quan)鏈條監(jian)管體系;三是(shi)(shi)堅持(chi)協同聯動,建立全(quan)(quan)方位監(jian)管機制;四是(shi)(shi)堅持(chi)群防群治,構建全(quan)(quan)社會共治格局(ju);五是(shi)(shi)堅持(chi)夯實基礎,落實全(quan)(quan)要素監(jian)管保障。

根(gen)據行(xing)(xing)政審批權限,《意見(jian)》對(dui)(dui)(dui)監(jian)管(guan)(guan)對(dui)(dui)(dui)象進行(xing)(xing)了詳細規定。其中(zhong)對(dui)(dui)(dui)保留(liu)行(xing)(xing)政審批的產品(pin),要(yao)求(qiu)強化全(quan)過程監(jian)管(guan)(guan);對(dui)(dui)(dui)下放審批權限的產品(pin),要(yao)求(qiu)強化審批監(jian)管(guan)(guan)承接;對(dui)(dui)(dui)轉變(bian)準(zhun)入方式的產品(pin),要(yao)求(qiu)強化制度轉換銜接;對(dui)(dui)(dui)非行(xing)(xing)政審批的產品(pin),要(yao)求(qiu)強化事(shi)中(zhong)事(shi)后(hou)監(jian)管(guan)(guan)。同時,對(dui)(dui)(dui)于對(dui)(dui)(dui)監(jian)管(guan)(guan)資源不足的問(wen)題(ti),《意見(jian)》要(yao)求(qiu)強化改(gai)革創新(xin),增加(jia)質量信(xin)息(xi)供給,減少(shao)市(shi)場信(xin)息(xi)不對(dui)(dui)(dui)稱;大(da)力(li)推行(xing)(xing)企業(ye)標準(zhun)自我(wo)聲明,探索(suo)建立(li)第三方質量安全(quan)評價制度,以市(shi)場機(ji)制倒(dao)逼質量提升;全(quan)面(mian)推行(xing)(xing)"雙(shuang)隨機(ji)一公(gong)開"等改(gai)革要(yao)求(qiu),公(gong)平、有效、透(tou)明地進行(xing)(xing)事(shi)中(zhong)事(shi)后(hou)監(jian)管(guan)(guan)。

《意見(jian)》要求,形成(cheng)全(quan)鏈條監(jian)管(guan)體系。要嚴格(ge)實施風險(xian)分析,全(quan)面建(jian)立質(zhi)(zhi)量(liang)安(an)全(quan)風險(xian)監(jian)測、風險(xian)研判、風險(xian)預(yu)(yu)警和(he)風險(xian)快速處置機(ji)制(zhi)(zhi),構(gou)建(jian)基(ji)于風險(xian)管(guan)理的(de)閉環監(jian)管(guan)模式(shi),及時發現(xian)問題,實現(xian)精(jing)準監(jian)管(guan)。要嚴格(ge)監(jian)督抽(chou)查和(he)檢(jian)(jian)驗檢(jian)(jian)疫,加(jia)快解(jie)決監(jian)督抽(chou)查"政出(chu)多門""數出(chu)多頭"問題,大(da)力(li)推行(xing)抽(chou)檢(jian)(jian)分離、全(quan)程(cheng)可視(shi)化監(jian)控和(he)盲樣檢(jian)(jian)測,嚴格(ge)承(cheng)檢(jian)(jian)工作質(zhi)(zhi)量(liang)考(kao)核,突(tu)出(chu)健(jian)康(kang)、安(an)全(quan)、節能、環保(bao)、貿(mao)易欺詐項目,加(jia)大(da)目錄外進出(chu)口商品抽(chou)查力(li)度。要加(jia)強對被采信(xin)機(ji)構(gou)的(de)管(guan)理。要嚴格(ge)執法(fa)打(da)假,持續開展維(wei)護中國制(zhi)(zhi)造海外形象的(de)"清風行(xing)動(dong)",組織(zhi)開展"質(zhi)(zhi)檢(jian)(jian)利劍"行(xing)動(dong),重拳打(da)擊質(zhi)(zhi)量(liang)違法(fa)行(xing)為,始終保(bao)持執法(fa)打(da)假高(gao)壓態勢。要嚴格(ge)處置突(tu)發事件(jian),提(ti)高(gao)應急(ji)處置主動(dong)性,發生突(tu)發事件(jian)后,第(di)一(yi)時間啟動(dong)預(yu)(yu)案,第(di)一(yi)時間趕(gan)赴現(xian)場,第(di)一(yi)時間采取措施。

對于建立全(quan)方位(wei)監(jian)管(guan)(guan)機(ji)(ji)制(zhi),《意見(jian)》要(yao)求,要(yao)推(tui)(tui)進(jin)內外協(xie)(xie)同(tong)監(jian)管(guan)(guan),形(xing)成監(jian)管(guan)(guan)疊加效應,協(xie)(xie)調實(shi)(shi)施國內電商、跨境(jing)電商監(jian)管(guan)(guan)機(ji)(ji)制(zhi),共同(tong)培育"品質(zhi)電商",全(quan)面凈化網購環境(jing)。要(yao)推(tui)(tui)進(jin)上(shang)(shang)下(xia)協(xie)(xie)同(tong)監(jian)管(guan)(guan),加強(qiang)上(shang)(shang)下(xia)聯(lian)(lian)動,融(rong)合各個層(ceng)級的業(ye)(ye)務信(xin)息(xi),實(shi)(shi)現(xian)互(hu)(hu)聯(lian)(lian)互(hu)(hu)通、數據共享和業(ye)(ye)務協(xie)(xie)同(tong)。要(yao)推(tui)(tui)進(jin)部(bu)(bu)門(men)(men)協(xie)(xie)同(tong)監(jian)管(guan)(guan),完善部(bu)(bu)門(men)(men)間(jian)信(xin)息(xi)互(hu)(hu)通、抽檢互(hu)(hu)認、監(jian)管(guan)(guan)互(hu)(hu)助機(ji)(ji)制(zhi),實(shi)(shi)現(xian)一(yi)個部(bu)(bu)門(men)(men)發現(xian)、其他部(bu)(bu)門(men)(men)共同(tong)跟進(jin)處理(li)。要(yao)推(tui)(tui)進(jin)區(qu)域協(xie)(xie)同(tong)監(jian)管(guan)(guan),對于上(shang)(shang)下(xia)游產(chan)品質(zhi)量關聯(lian)(lian)度較高(gao)的產(chan)業(ye)(ye),以及同(tong)一(yi)產(chan)業(ye)(ye)的不同(tong)聚(ju)集區(qu),要(yao)積(ji)極(ji)開展(zhan)區(qu)域聯(lian)(lian)動監(jian)管(guan)(guan)。

《意見》提出,要落(luo)(luo)實(shi)企業質(zhi)量(liang)(liang)(liang)主體責任(ren)(ren),落(luo)(luo)實(shi)質(zhi)檢(jian)監管(guan)(guan)責任(ren)(ren),落(luo)(luo)實(shi)用戶(hu)單位質(zhi)量(liang)(liang)(liang)驗(yan)收把關責任(ren)(ren),落(luo)(luo)實(shi)檢(jian)驗(yan)認證機構質(zhi)量(liang)(liang)(liang)連(lian)帶責任(ren)(ren),落(luo)(luo)實(shi)地(di)方政府領導責任(ren)(ren),動員(yuan)社(she)會力(li)量(liang)(liang)(liang)參與(yu)質(zhi)量(liang)(liang)(liang)監管(guan)(guan),構建全社(she)會共(gong)治格局。《意見》要求,加強法律法規和標(biao)準(zhun)體系(xi)建設,加強質(zhi)量(liang)(liang)(liang)監管(guan)(guan)信息化建設,加強基層質(zhi)量(liang)(liang)(liang)監管(guan)(guan)力(li)量(liang)(liang)(liang)建設,落(luo)(luo)實(shi)全要素(su)監管(guan)(guan)保障。

《意見》指出,加強(qiang)全面質(zhi)量監管事(shi)關供(gong)給側(ce)結(jie)構(gou)性改革,事(shi)關經濟社會健(jian)康發展,事(shi)關黨(dang)和(he)政(zheng)府(fu)的(de)(de)形象,事(shi)關人民群眾福祉。要強(qiang)化組織保(bao)障(zhang)、機制保(bao)障(zhang),加強(qiang)對政(zheng)策措施(shi)落實情況的(de)(de)跟蹤督(du)查,嚴格考(kao)核獎懲。
